Avily Terms of Use

These Terms of Use govern your use of the Avily mobile application and related services operated by Software for Pilots ("Avily", "we", "us"). By creating an account or using Avily, you agree to these terms.

Eligibility and accounts

You must be legally able to enter into these terms and provide accurate account information. You are responsible for safeguarding your account credentials and for activity under your account. Please notify us promptly if you believe your account has been compromised.

Avily is a companion, not an operational authority

Avily helps aviation professionals organize schedules, records, layovers, connections and memories. It is not an official flight-planning, dispatch, rostering, safety, navigation or regulatory system. Always verify operational information against your airline, employer and applicable official sources. Do not rely on Avily for safety-critical decisions.

Your content

You retain ownership of photos, memories, records and other content you submit. You grant Avily a limited, non-exclusive license to host, process, reproduce and transmit that content only as needed to operate and improve the service. You are responsible for having the rights and permissions required to upload or share your content.

Acceptable use

You may not use Avily to violate the law, infringe another person's rights, harass others, distribute malicious code, gain unauthorized access, interfere with the service, scrape or reverse engineer the service except where the law permits, or upload confidential operational information you are not authorized to share.

Subscriptions and payments

Paid features may be offered through Apple's App Store. Prices, billing periods, renewals, cancellations and refunds are handled under the terms shown at purchase and the rules of your Apple Account. Deleting Avily does not automatically cancel a subscription.

Third-party services

Avily may depend on or link to third-party services. Their products, availability and terms are outside our control, and your use of them may be governed by separate terms and privacy policies.

Service changes and availability

We may add, change, suspend or discontinue features. We work to keep Avily available and reliable, but the service is provided on an "as available" basis and may occasionally be interrupted.

Termination

You may stop using Avily at any time. We may suspend or terminate access when reasonably necessary to protect Avily or its users, enforce these terms, address unlawful conduct or comply with legal obligations. Provisions that by their nature should survive termination will continue to apply.

Disclaimers and limitation of liability

To the maximum extent permitted by law, Avily is provided without warranties of uninterrupted or error-free operation. Software for Pilots will not be liable for indirect, incidental, special, consequential or punitive damages, or for losses arising from reliance on unofficial or inaccurate operational information. Nothing in these terms excludes rights or liability that cannot legally be excluded.

Changes to these terms

We may update these terms as Avily changes. We will publish the revised terms here and update the effective date. If a change is material, we may also provide notice through the app.
